Extracurricular internship

By extracurricular internship we mean, pursuant to art. 13 of the lrn 69/1981 and sm and i., A training experience carried out by subjects who have fulfilled the obligation of education and who are unemployed or unemployed pursuant to Legislative Decree no. 181/2000 (enrolled at the Employment Center) in the context of a work context with public or private employers, which is not configured as an employment relationship and which is aimed at orienting occupational choices.

The extracurricular internships are divided into:

Training and orientation internships

Intended for those who have obtained a degree or a professional qualification in the twelve months preceding the start of the internship;

Internships aimed at insertion / reintegration into work

Mainly aimed at the unemployed, including those on the move and the unemployed;

Summer internships

In favor of young people who have fulfilled the obligation of education and who are regularly enrolled in a cycle of studies at an educational institution or included in a vocational training course in the context of the right-duty of education and training. These internships take place in the period between the end of the school year and the beginning of the following one.

Extracurricular internship

All public or private bodies, companies and their consortia, associations, foundations and their consortia, cooperatives and their consortia, as well as individuals exercising the liberal professions individually or associated.

The host organization can, for the same professional profile, consecutively accept more internships for no more than twenty-four months in total, except in the case in which at least one third of the internships activated, rounded up to the next higher unit, have given rise to a subordinate employment contract. lasting no less than twelve months.

The host organization must not have extraordinary, ordinary or derogating CIG procedures in progress in the same operating unit that concern workers who carry out activities equivalent to those of the training course.
The host cannot activate internships in the event that, in the previous twelve months, it has carried out collective or individual or multiple dismissals for justified objective reasons, as well as mobility procedures for staff reduction, limited to organizational areas (e.g. offices , departments) and to the professional figures affected by the reduction in personnel.
The host organization cannot carry out more than one internship with the same intern, without prejudice to the possibility of extending the internship within the limits of duration.

In any case, in the six months preceding the activation of the measure, there must be no employment contracts or self-employment and / or para-subordinate employment relationships between the trainee and the host.
The host cannot host the workers dismissed by the host in the previous twenty-four months as trainees.
The host organization, based on the numerical size of the operational unit or the registered office where the internship takes place, can simultaneously accommodate a number of internships, whether curricular or extra-curricular, within the limits indicated below:

Permanent employees

Units with between zero and five permanent employees: a trainee; in the absence of employees, the host must ensure tutoring also through an external subject in the case of a network of companies;

0-5

Permanent employees

A trainee; in the absence of employees, the host must ensure tutoring also through an external subject in the case of a network of companies;

+20

Permanent employees

Units with a number equal to or greater than twenty permanent employees: trainees not exceeding ten per cent of the aforementioned employees at the same time, with rounding up to the next higher unit.

The working members of cooperatives and workers hired with an apprenticeship contract are considered as permanent employees.

Duration and time

The duration varies according to the purposes and recipients and cannot exceed:

a) 6 months for training and orientation internships;
b) 12 months for internships for reintegration / integration purposes;
c) 3 months for summer internships.

The maximum hours are defined on the basis of the reference employment contract and the minimum hours cannot be less than 20 hours per week.

Commitments of the Host

(Participation Indemnity, Insurance Guarantees, Worker Training, SARE Communication).
The internship does not constitute a subordinate employment relationship but in any case involves the obligation of an allowance by the company of a minimum of € 300,00 gross per month for activities up to a maximum of twenty-four hours per week and a minimum of € 400,00 gross per month if the weekly commitment is equal to or greater than twenty-five hours.

The hosts must also arrange for the trainees' insurance against accidents at work with INAIL and with an insurance company for civil liability towards third parties.

The host organization has the obligation to guarantee to the trainees, within a reasonable time from the start of the internship itself, General Training and Specific Training in accordance with the Agreement between the Minister of Labor and Social Policies, the Minister of Health. , the Regions and the Autonomous Provinces of Trento and Bolzano for the training of workers pursuant to art. 37, paragraph 2, of Legislative Decree no. 81/2008.
Host organization is obliged to notify the competent Employment Center of the start date of the internship within the day before its activation (failure to comply with this obligation provides for the application of the sanctions established by Article 19 paragraph 3 of Legislative Decree 276/2003).

Activation Methods and Procedure

The internship is activated on the basis of an activation request, an agreement and a training project
ITER is able to guarantee the company the coverage of all the activation procedures, that is: preparing the activation request, the agreement and the training project. It provides a tutor who ensures constant ongoing and final monitoring of the internship activity.
The host organization must provide:

1) Trainee data

Curriculum vitae, path of the worker (historical C2) of the Employment Center in which he is enrolled

2) Own data

Registered office, place of the internship, telephone number, VAT number, legal representative name and relative place and date of birth, internship manager, n. total employees, no. permanent employees, sector and company activity, ATECO Code, Applied National Collective Labor Agreement

3) INAIL position
4) Civil liability position

Policy number and company for damages that the trainee can cause to third parties

5) Professional position of the trainee
6) Duration, days and times of the internship
7) Reimbursement of expenses
